There is more than $3 Trillion set to pass between generations over the next 20 years and many Australian families with nil or ineffective estate plans that places investment properties, shares, superannuation and the principal place of residence are at risk. Let’s face it with this sort of money, expect legal challenges galore and with an average cost of 10+% of the estate going in legal fees to fight a Family Provisions challenge, litigation lawyers’ incomes and fancy lifestyles will be underwritten for decades to come.
Challenging an estate under the Family Provisions laws can be undertaken by any “eligible person” which is the traditional spouse and children, but can you believe it, extends to former spouses, anyone who is partially dependant on the deceased, adopted children and grandchildren. The essence of the claim is that you believe you deserve more than was received under the deceased’s estate. It’s no wonder that so many estates end up with family provision claims that take years and with the Supreme Court the court of jurisdiction, it’s happy days for the lawyers! And it is not big estates, even smaller $600,000 estates have seen $500,000 in legal fees contesting the estate.
This two day training with Succession and Estate Planning expert, trainer and mentor Grant Abbott will lead you through building tight and secure multi-generational succession planning and protection of a family’s wealth through the use of Trusts, SMSFs and SMSF Death Benefit Trusts before you even get to the Estate. It is hard to challenge an estate when there is nothing in it. Grant will be going through the law and the five case studies:
1.Retirees in pension phase with one favoured son with grandchildren and a daughter to be left out of the will;
2.Farming family seeking to preserve their property for future generations;
3.Small business owner with home, mortgage, teenage children, good cash flow but crazy in laws and $300,000 in super;
4.Client with terminal cancer, significant estate and super and expected hotly contested will;
5.55 year old Parents with three children including one disabled child seeking to ensure the child is looked after for the rest of her life.
Each case study will have a suggested solution and also what documentation and work flow is required to make it happen, quickly and effectively. This is a training course for accountants, tax agents and financial planners looking to be a proactive family protection adviser offering clients – safety, certainty and security. We will also be looking at what it means to be a Professional Trustee or adviser for your succession planning client’s ongoing affairs in the event of incapacity or on death and beyond – a great opportunity.
The accreditation is by the Association of Succession and Estate Planning Advisers (ASEPA) a new association currently being formed that will quickly grow and provide industry standards and status for advisers. Our first attendees will have a hand in setting the mission of the Association and it’s organisational structure and membership requirements.
